GENERAL TERMS AND CONDITIONS OF USE OF THE WEBSITE
The Site is published by SARL DU FROLET, an individual wine-producing company incorporated under French law, whose registered office is located at 13 route du Petit Morlut, 17800 Chadenac, France, registered with the Saintes Trade and Companies Register under number B 509 024 873 (hereinafter ‘DU FROLET’).
The use of the Site by any person (hereinafter ‘you’ or ‘the user’), whatever the purpose of their visit, is governed by these general conditions of use (hereinafter the ‘General Conditions of Use’). The purpose of the General Conditions of Use is to define the conditions of access, browsing and use of the Site.
By accessing and using the Site, you accept unreservedly the application of the General Conditions of Use and the clauses applicable to the protection of personal data (see the Personal Data Charter).
DU FROLET may modify and update the General Conditions of Use and the Personal Data Charter at any time. The user is invited to consult them regularly online.
To access the Site, you must be of legal drinking and/or purchasing age according to the legislation in force in your country of residence (the highest age being taken into consideration).
If there is no legal age in your country of residence, you must be at least 21 years old to access the Site.
- NAVIGATION ON THE SITE
1.1. Access to the Site
Users of the Site are responsible for the hardware and software required to access the Internet and the Site.
DU FROLET reserves the right, at its sole discretion, to suspend or terminate access to all or part of the Site, its content or the services offered on the Site, without prior notification and without this being liable to give rise to any compensation to a user.
It is strictly forbidden to modify the software elements of the Site with a view to obtaining unauthorised access to the Site.
1.2 Hypertext links

Insofar as DU FROLET cannot control these external sites and sources, DU FROLET cannot be held responsible for the content, advertising, products, services or any other element available on these external sites or sources. Furthermore, DU FROLET may not be held liable for any damage or loss (proven or alleged) arising directly or indirectly from the use of the content, goods or services available on these external sites or sources.
1.3 User behaviour
Each user of the Site guarantees :
– they are of legal age to consume and/or purchase alcohol in accordance with the legislation in force in their country of residence;
– to use the Site for lawful and personal purposes, to the exclusion of any use for commercial purposes, except with the prior written consent of DU FROLET;
Users must behave on the Site in a responsible, lawful, courteous and respectful manner with regard to the rights of other users of the Site, DU FROLET and third parties.
In particular, users must refrain from :

- seeking to evaluate, ascertain or test the vulnerability of the Site, or infringing the security or authentication measures of the Site without the prior written consent of DU FROLET;
- engage in any illegal activity or any other activity likely to prejudice the rights of DU FROLET, its suppliers, service providers, retailers, advertisers or other persons, and refrain from encouraging third parties to do so;
- upload to the Site, transmit, post or otherwise make available unsolicited or unauthorised advertising or promotional materials, ‘junk mail’, ‘spam’, ‘chain letters’ or any other form of solicitation ;
- upload to the Site, post, e-mail or transmit any content that is unlawful, harmful, defamatory, offensive, racist, vulgar, obscene, threatening, violent, immoral, invasive of a person’s privacy, derogatory or racially, ethnically or otherwise objectionable;
- send by e-mail or transmit by any other means any content of the Site to persons under the legal age to consume and/or purchase alcohol in their country of residence or residing in a country that restricts or prohibits the advertising of alcoholic beverages.
Each user undertakes to comply with all applicable laws, rules and procedures relating to online user behaviour and the transmission of technical data.
Where applicable, DU FROLET may terminate a user’s right of access to the Site at any time if the user does not comply with the obligations incumbent upon him/her under the General Conditions of Use, without prejudice to DU FROLET’s right to claim damages.
1.4 Content published by users
Where applicable, users of the Site are solely responsible for the content they post on the Site and for the consequences of its dissemination. DU FROLET does not endorse any content, opinion, recommendation or advice expressed by users on the Site, and declines all responsibility for content posted on the Site.
However, DU FROLET reserves the right (but not the obligation) to determine whether content posted by users complies with the requirements specified in the Terms of Use and may remove any content that violates these Terms of Use and/or terminate a user’s access to the Site as a result of the submission of such content, at any time, without notice and in its sole discretion.
You accept that DU FROLET may freely use, without any restriction or time limit and free of charge, the content posted on the Site not only for its distribution on the Site but also for its distribution and reproduction on any other medium whatsoever for the promotion and advertising of DU FROLET, its products and its services.
2. PROTECTION OF SITE CONTENT
The Site and each of the elements that make it up (such as texts, tree structures, software, animations, photographs, illustrations, images, diagrams, soundtracks, texts, logos, trademarks, drawings and models), including the software elements necessary for the operation of the Site, databases and newsletters (hereinafter the ‘Content’) may contain confidential information and data protected by intellectual property law or any other applicable law. Thus, unless otherwise stated on the Site, the intellectual property rights on the Content are the exclusive property of DU FROLET, which does not grant the user any licence or any right other than that of consulting the Site.
Reproduction of all or part of the Content is authorised solely for information purposes for personal and private use, any reproduction and any use of copies of the Content made for other purposes, in any manner whatsoever and in any form whatsoever, being expressly prohibited.
The user is also prohibited from copying, modifying, creating a derivative work, assembling, decompiling, assigning, sub-licensing or transferring in any way whatsoever any right relating to the Content or the Site.

DU FROLET ensures the protection of personal data transmitted by users of the Site. DU FROLET invites users of the Site to consult the Personal Data Charter, which sets out the measures put in place to guarantee data processing. 4. RESPONSIBILITY
DU FROLET endeavours to ensure, to the best of its ability, that the information published on the Site is accurate and up-to-date. However, DU FROLET cannot guarantee the accuracy, precision or exhaustiveness of the information made available to users on the Site.
DU FROLET provides access to the Site free of charge and accepts no liability :

5. APPLICABLE LAW AND COMPETENT JURISDICTION
The General Terms and Conditions of Use and the Personal Data Charter referred to herein are governed by French law.
Unless otherwise provided by mandatory law, any dispute concerning the Content and the use of the Site shall fall within the exclusive jurisdiction of the competent court within the jurisdiction of the Paris Court of Appeal, including in the event of a third party claim, multiple defendants or summary proceedings or proceedings by petition.
